The terms that govern your use of this website and your requests for non-emergency medical transportation.

1. Agreement to These Terms

These Terms of Service (“Terms”) govern your access to and use of the ProVital Transit website and your submission of ride requests through it. By using this site or submitting a request, you agree to these Terms. If you do not agree, please do not use the site.

In these Terms, “ProVital Transit,” “we,” “us,” and “our” refer to ProVital Transit, a non-emergency medical transportation provider based in Charlotte, North Carolina.

2. About Our Services

ProVital Transit provides scheduled, non-emergency medical transportation (NEMT) — including wheelchair-accessible, ambulatory, stretcher, dialysis, senior, hospital-discharge, and long-distance medical transport — across the Charlotte metro.

We are not an emergency service and do not provide medical care or ambulance service. If you are experiencing a medical emergency, call 911 immediately. Our drivers provide transportation and passenger assistance, not clinical or medical treatment.

3. Eligibility & Acceptable Use

You must be at least 18 years old (or have the authority of a parent, guardian, or caregiver) to submit a request. You agree to use the site only for lawful purposes and to provide accurate, current, and complete information.

You agree not to:

  • Submit false, misleading, or fraudulent information or requests.
  • Use the site or forms to harass, abuse, or harm others.
  • Attempt to gain unauthorized access to the site, its systems, or data.
  • Interfere with or disrupt the site, including by introducing malicious code or automated abuse.
  • Use the site in violation of any applicable law or regulation.

4. Ride Requests & Bookings

Submitting a request through this website is the start of a conversation — it is not a confirmed booking. A trip is only scheduled once a ProVital Transit coordinator confirms the details with you, including pickup time, addresses, level of assistance, and any accessibility needs.

Service is subject to availability, vehicle and staffing capacity, eligibility, and serviceability of the requested area and times. We recommend booking in advance; recurring trips can be set up as standing orders. You are responsible for the accuracy of the information you provide, including addresses, contact details, and mobility requirements.

5. Insurance, Coverage & Payment

Coverage for non-emergency medical transportation varies by plan and trip. Whether a ride is covered — and any limits, prior-authorization, or notice requirements — is determined by your insurer, Medicaid/Medicare plan, broker, or facility, not by ProVital Transit. We do not guarantee coverage, and we will help you understand and verify coverage before you ride.

Where a trip is not covered, or where you choose private pay, you are responsible for the applicable fees, which we will communicate before service. Fees for cancellations, no-shows, wait time, additional stops, or long-distance trips may apply as disclosed at the time of booking.

6. Cancellations, Changes & No-Shows

Please give us as much notice as possible if you need to cancel or change a trip so we can re-route resources to other riders. Late cancellations and no-shows may be subject to a fee as disclosed at booking. If we are unable to complete a scheduled trip due to circumstances within our control, we will work with you to reschedule promptly.

7. Rider Responsibilities

To help every trip go safely and on time, you agree to:

  • Provide accurate pickup/drop-off details and be ready at the scheduled time.
  • Tell us in advance about wheelchair, stretcher, oxygen, or other accessibility needs.
  • Follow reasonable safety instructions from your driver, including securement and seatbelt use.
  • Treat drivers and staff with respect; we reserve the right to decline or end service in cases of unsafe or abusive behavior.

8. No Medical Advice

Content on this website — including blog articles and guides — is provided for general informational purposes only and is not medical, legal, or insurance advice. It is not a substitute for professional guidance. Always follow the instructions of your healthcare providers and confirm coverage details with your plan.

9. Third-Party Services & Links

The site may reference or link to third-party websites, programs, plans, and resources that we do not operate or control. We provide these for convenience only and are not responsible for their content, availability, or practices. Your use of any third-party service is subject to that party’s own terms and policies.

10. Intellectual Property

The site and its content — including text, graphics, logos, the ProVital Transit name and brand, and the design and layout — are owned by ProVital Transit or its licensors and are protected by intellectual-property laws. You may view and use the site for your personal, non-commercial purpose of arranging transportation. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission.

11. Disclaimers

The website is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or secure, or that information on it is complete or current.

12. Limitation of Liability

To the fullest extent permitted by law, ProVital Transit and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or goodwill, arising out of or relating to your use of (or inability to use) this website. Nothing in these Terms limits any liability that cannot be limited under applicable law. These website Terms govern your use of the site; the terms applicable to a specific transportation trip will be confirmed with you at booking.

13. Indemnification

You agree to indemnify and hold harmless ProVital Transit and its owners, employees, and agents from any claims, damages, losses, and reasonable expenses (including attorneys’ fees) arising out of your misuse of the site, your violation of these Terms, or your violation of any law or the rights of a third party.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the website will be subject to the exclusive jurisdiction of the state and federal courts located in Mecklenburg County, North Carolina, unless otherwise required by applicable law.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the site after changes take effect means you accept the revised Terms. If you do not agree to the changes, please stop using the site.

16. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, are the entire agreement between you and ProVital Transit regarding the website.
